TERMS OF SERVICE

These Terms of Service (“Terms”) govern the provision of electrical services by Rudder Electric (“Company,” “we,” “us,” or “our”) to you (“Customer,” “you,” or “your”). By requesting, scheduling, or receiving services from Rudder Electric, you agree to be bound by these Terms.

1. Services

Rudder Electric provides residential, commercial, and/or industrial electrical services, including but not limited to installation, repair, maintenance, inspection, and consultation services (collectively, the “Services”). All Services are subject to availability and may require an on-site assessment.

2. Estimates and Pricing

Estimates are provided based on the information available at the time and may be subject to change if conditions differ from those originally disclosed or observed.

Unless otherwise stated in writing, estimates are not guaranteed prices.

Additional work requested or required will be billed at the Company’s standard rates.

3. Payment Terms

Payment is due upon completion of Services unless otherwise agreed to in writing.

We accept approved forms of payment as communicated prior to or at the time of service.

Late payments may be subject to fees, interest, or collection costs as permitted by law.

The Company reserves the right to suspend or withhold Services for non-payment.

4. Scheduling, Access, and Cancellations

You agree to provide safe, timely access to the service location.

Missed appointments or cancellations without reasonable notice may be subject to a service or cancellation fee.

We are not responsible for delays caused by factors beyond our control, including weather, material availability, or unsafe working conditions.

5. Customer Responsibilities

You agree to:

Provide accurate information regarding the property, electrical systems, and scope of work.

Ensure the worksite is safe and compliant with applicable laws and regulations.

Obtain any required permissions, approvals, or access rights unless otherwise agreed in writing.

6. Permits and Code Compliance

Unless expressly stated otherwise, Rudder Electric will perform Services in accordance with applicable electrical codes and standards. Permit responsibilities will be communicated prior to service and may vary by jurisdiction.

7. Warranties and Disclaimers

Rudder Electric warrants that Services will be performed in a professional and workmanlike manner.

Manufacturer warranties may apply to materials or equipment and are subject to the manufacturer’s terms.

EXCEPT AS EXPRESSLY STATED HEREIN, THE COMPANY DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, TO THE EXTENT PERMITTED BY LAW.

8. Limitation of Liability

To the fullest extent permitted by law:

Rudder Electric shall not be liable for any indirect, incidental, consequential, or special damages.

The Company’s total liability for any claim arising out of or related to the Services shall not exceed the amount paid by you for the Services giving rise to the claim.

9. Indemnification

You agree to indemnify and hold harmless Rudder Electric, its owners, employees, and contractors from any claims, damages, losses, or expenses arising out of or related to your breach of these Terms or misuse of the Services.

10. Safety

Rudder Electric reserves the right to refuse or stop work if unsafe conditions exist. You agree not to interfere with the safe performance of the Services.

11. Changes to Services or Terms

We reserve the right to modify these Terms at any time. Updated Terms will be effective upon posting or written notice. Continued use of Services constitutes acceptance of the revised Terms.

12. Termination

Either party may terminate Services upon written notice, subject to payment for Services performed and costs incurred up to the date of termination.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the state in which Rudder Electric primarily operates, without regard to conflict of law principles.

14. Dispute Resolution

Any disputes arising under these Terms shall be resolved through good-faith negotiation. If unresolved, disputes may be subject to mediation or binding arbitration, as permitted by law, or brought in a court of competent jurisdiction.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms constitute the entire agreement between you and Rudder Electric regarding the Services and supersede any prior agreements or understandings, whether written or oral.
